Welcome to WildCard Nature. By using our mobile application, you agree to these Terms of Service ("Terms"). Please read them carefully.
1. Acceptance of Terms
By downloading, installing, or using WildCard Nature ("the App"), you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
2. Description of Service
WildCard Nature is a mobile application that allows users to:
- Photograph wildlife using their device camera
- Generate AI-stylized digital trading cards from photos
- Collect and manage a personal card collection
- Optionally mint cards as NFTs on the Solana blockchain
3. Account Registration
- You must sign in with a valid Google account to use the App
- You are responsible for maintaining the security of your account
- You must be at least 13 years old to use the App
- One account per person; multiple accounts are not permitted
4. User Content
Your Photos
- You retain ownership of photos you take with the App
- You grant us a license to process your photos for card generation
- You must only photograph wildlife you have legal right to photograph
- Do not photograph protected wildlife in restricted areas
Generated Cards
- AI-generated card artwork is created using your photos as input
- You own the digital cards in your collection
- Cards minted as NFTs are subject to blockchain ownership rules
5. Acceptable Use
You agree NOT to:
- Use the App for any illegal purpose
- Upload photos containing inappropriate, offensive, or illegal content
- Attempt to reverse-engineer, hack, or exploit the App
- Use automated systems or bots to generate cards
- Harass wildlife or violate wildlife protection laws
- Misrepresent species identification intentionally
- Create duplicate accounts to circumvent daily limits
6. NFT Minting and Blockchain
Important: NFT minting involves the Solana blockchain, which is a public, decentralized network outside our control.
- You are responsible for your Solana wallet and private keys
- Blockchain transactions are irreversible
- We charge a 5% royalty on secondary NFT sales
- Gas fees and network costs are your responsibility
- We cannot recover lost wallets or reverse transactions
- NFT value is not guaranteed and may fluctuate
7. Daily Limits and Fair Use
- Card generation is limited to 5 cards per day
- Maximum of 4 cards per species in your collection
- Limits exist to ensure fair access for all users
- Attempting to circumvent limits may result in account suspension
8. Intellectual Property
- The App, its design, and features are owned by WildCard Nature
- AI art styles and card templates are our intellectual property
- You may not copy, modify, or distribute the App
- User-generated cards are for personal use and NFT minting only
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:
- Uninterrupted or error-free service
- Accuracy of AI-generated content or species identification
- Value or liquidity of minted NFTs
- Availability of third-party services (Solana, AI providers)
10. Limitation of Liability
To the maximum extent permitted by law, WildCard Nature shall not be liable for:
- Loss of digital assets, NFTs, or cryptocurrency
- Lost data or card collections
- Damages arising from blockchain transactions
- Third-party service failures
- Any indirect, incidental, or consequential damages
11. Termination
- You may delete your account at any time
- We may suspend or terminate accounts that violate these Terms
- Upon termination, your local card collection will be deleted
- NFTs already minted remain on the blockchain
12. Changes to Terms
We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. Material changes will be communicated through the App.
13. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of South Carolina, United States.
